Patentability Search Service

Posted in: Blog

my name is James Yang. I'm a patent attorney,
engineer, and author. My patentability search   service isn't a run-of-the-mill patent search.
I don't just search for keywords in a patent   database. For me, it starts with the initial
consultation or strategy session. I need to   figure out what your invention is, not just what
you think your invention is.

But the crux of it.   It's what we call the point of novelty. I
then write up a brief description of what   the invention is and we both have to agree that
that's the invention. Then we start to search. Our   search is the same search suggested by the USPTO.
They do what's called a class subclass search.   You see, all inventions are categorized into
one or more of 450 different classes. Each   class has about a thousand different subclasses.
We select the right class subclass combinations   for your invention and do the keyword searching.
It's a bit of a feedback loop when you do it right   because we're finding more classes and subclasses
as we do the search. Then you have to redo some   parts of the search. It's been our experience
that our search knocks out about one half of   all inventions. At first you might
not want to hear it but think of it this way,   I just saved you money and time. Not only
for the patent costs but for the time and   expense for launching a business based on your
product.

Typically we find something close and   that isn't necessarily a bad thing. It helps us
figure out what we can and can't get a patent on   and if you do move forward with the patent
application we can focus the patent application   on those areas where we think we have the
best chance of getting a patent. If you're  .
